Terms of Service

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use our Services. By using the Services, you represent and warrant that you meet these requirements. Our Services are intended for individuals seeking sterile processing technician training and related professional development.

3. Account Registration and Responsibilities

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws
• Share your account credentials or allow others to access the Services through your account
• Copy, download, distribute, or otherwise exploit course materials, videos, or content outside the platform
• Attempt to circumvent any access controls, payment requirements, or technical limitations
• Use automated systems (bots, scrapers, etc.) to access the Services without our written permission
• Interfere with or disrupt the Services or servers/networks connected to the Services
• Transmit viruses, malware, or other harmful code

5. Intellectual Property

All content on the Services—including but not limited to text, graphics, logos, images, videos, presentations, quizzes, flashcards, and software—is the property of Sevy SPD, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any of our content without our prior written consent. Your enrollment grants you a limited, non-exclusive, non-transferable license to access and view course materials for your personal educational use only during your active enrollment period.

6. Course Access and Enrollment

Course access is subject to enrollment, payment, and our module gating rules. Access to modules may be limited based on:

• Your payment plan or tier (e.g., Full Access, Bi-Weekly, Weekly, Half Access)
• Sequential completion of prior modules
• Active enrollment status

We reserve the right to modify course structure, content, or access rules. Refunds and cancellations are governed by our Refund & Cancellation Policy.

7. Payments

Payment terms, pricing, and billing are presented at the time of enrollment. By completing a purchase, you agree to pay all applicable fees. We use Stripe for payment processing. You authorize us to charge your chosen payment method in accordance with your selected plan. Failure to pay may result in suspension or termination of access. 8. User Content and Community

Our Services may include community features such as forums, discussions, and user-generated content. When you post content:

• You retain ownership of your content but grant us a license to use, display, and distribute it in connection with the Services
• You represent that you have the right to post such content and that it does not violate any third-party rights or applicable laws
• You agree not to post harassing, defamatory, obscene, or otherwise objectionable content

We may remove content that violates these Terms or our community guidelines without notice. We are not responsible for user-generated content.

9. Certificates and Credentials

Certificates of completion are issued upon successful completion of course requirements. Our training is designed to prepare you for industry certifications (e.g., CRCST, CSPDT); however, we do not guarantee that you will pass any external certification exam. Certification exam fees, registration, and requirements are governed by the respective certifying bodies, not Sevy SPD.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. OUR TRAINING IS FOR EDUCATIONAL PURPOSES; WE DO NOT GUARANTEE EMPLOYMENT, CERTIFICATION PASS RATES, OR SPECIFIC OUTCOMES. YOU USE THE SERVICES AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEVY SPD, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sevy SPD, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to access the Services ceases immediately. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) shall survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any dispute arising from these Terms or the Services shall be resolved in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of such courts.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Services.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
